Scope of Application
These General Terms and Conditions apply to contracts for the temporary rental of holiday apartments for accommodation purposes, as well as all further services and deliveries provided by the landlord to the tenant.
Subletting or further renting of the holiday apartment, as well as its use for purposes other than residential, requires the prior written consent of the landlord.
Arrival & Departure
The holiday apartment is available from 3:00 pm on the day of arrival, or by prior arrangement. Access is via a personal numeric code, which will be communicated before arrival.
On the day of departure, the apartment must be vacated by 10:00 am, or by prior arrangement. The landlord reserves the right to charge for a departure more than 60 minutes late.
If the tenant fails to arrive on the day of arrival by 10:00 pm without having notified the landlord, the contract shall be deemed terminated after a period of 48 hours. A pro-rata refund of the rent due to early departure will not be granted. The landlord may then make the property available for re-rental.
Special Requests & Side Agreements
Special requests and side agreements are generally possible and require written confirmation by the landlord. For pets, the type and size must be specified in advance.
Payment
A deposit of 20% of the rental amount is due within 14 days of receipt of the invoice. The remaining balance is due 3 weeks before the start of the rental. For short-notice bookings (less than 3 weeks before arrival), the total amount is due immediately upon booking confirmation.
If payment deadlines are not met, the landlord may withdraw from the contract. Non-payment is treated as withdrawal and entitles the landlord to re-rent the property.
Utility costs for water, electricity, parking and waste disposal are included in the rental price. Depending on the location of the rental property, the relevant municipality may levy a health resort tax or tourism tax, which is payable in addition to the rental price and must be paid to the landlord together with the balance payment. (e.g. Büsum: Kurabgabe; Bergisch Gladbach: Tourism tax).
Cancellation
In the event of withdrawal from the rental agreement, the tenant is obliged to pay compensation. Cancellation must be made in writing. The amount depends on the time of cancellation:
- Up to 8 weeks before
- No cancellation fee
- Up to 4 weeks before
- 50% of rental price
- Up to 2 weeks before
- 80% of rental price
- 3 days or less before
- 100% of rental price
The date of receipt of the cancellation notice applies. Amounts already paid will be offset. The tenant may nominate a substitute person who takes over the contract on the same terms; written notification is sufficient.
Guest Obligations
The tenant undertakes to treat the holiday apartment, pool or jacuzzi, inventory and outdoor facilities with care. Damage must be reported to the landlord immediately. Defects already noticed on arrival must be reported straight away — otherwise the tenant will be held liable. Complaints received only after departure are excluded from compensation claims.
On the day of departure, personal belongings must be removed, household waste disposed of in the designated containers, dishes left clean and stored, and windows and doors closed.
If the tenant wishes to use their personal liability insurance to cover any damage, they must provide the landlord with the name, address and insurance policy number.
Privacy
Personal data collected in connection with the rental agreement will be processed solely for the purpose of contract fulfilment and will not be passed on to third parties. Further information can be found in our Privacy Policy.
Liability
The listing has been created to the best of our knowledge. No liability is accepted for disruptions caused by force majeure, locally customary power or water outages, storms or unforeseeable official orders. The landlord is happy to assist in resolving problems where possible.
Liability for the use of sports and leisure equipment provided as well as the pool is excluded. Arrival and departure are at the tenant's own risk. The landlord accepts no liability for personal belongings in the event of theft or fire. The tenant is fully liable for any wilful damage.
Final Provisions
Photos and descriptions on the website are intended to provide a realistic representation. A 100% match cannot be guaranteed. The landlord reserves the right to make equivalent changes to the furnishings.
Should individual provisions of these T&Cs be invalid, this shall not affect the validity of the remaining provisions. German law applies. The place of jurisdiction and fulfilment is the registered office of Hostyou GmbH in Elpersbüttel (Amtsgericht Pinneberg).
